利用規約
本利用規約（以下「本規約」といいます。）は、MONOLOG の開発者（以下「当方」といいます。）が提供する iOS アプリケーション「MONOLOG」（以下「本アプリ」といいます。）の利用条件を定めるものです。本アプリをご利用になる方（以下「ユーザー」といいます。）は、本規約に同意のうえご利用ください。
1. 適用範囲
本規約は、無料機能の利用者及び有料プラン（Premium）の利用者を含む、本アプリのすべてのユーザーに適用されます。本アプリのダウンロード又は利用開始をもって、ユーザーは本規約に同意したものとみなします。
2. 未成年者の利用
未成年者が本アプリを利用する場合は、親権者その他の法定代理人の同意を得たうえでご利用ください。未成年者が本アプリを利用した場合、法定代理人の同意があったものとみなします。
3. ライセンス
当方は、ユーザーに対し、本規約の条件に従うことを前提に、ユーザー自身が所有又は管理する Apple 製デバイス上で本アプリを使用するための、非独占的、譲渡不能、再許諾不可、取消可能な限定的ライセンスを付与します。本アプリの利用には、Apple 社の標準 EULA（Licensed Application End User License Agreement）も適用され、本規約はこれを補完するものとします。
4. 有料プラン（Premium）
本アプリの中核機能（テキスト・音声記録、タグ、カレンダー、検索、Face ID、音声原音保存、エクスポート／インポート等）は永続的に無料で提供されます。Premium プランは AI 機能の利用に必要となります。

4.2 自動更新の表示
サブスクリプションは期間終了の 24 時間以上前に解約しない限り自動更新されます。 課金は Apple ID に対して行われ、 解約は iOS の「設定」 → 「Apple ID」 → 「サブスクリプション」 から可能です。
更新時の課金額は、解約しない限り、各プランの提示価格と同額です。プラン期間中の解約による日割返金はなされません。
4.3 永久プラン
永久プランは一度の支払いにより、当該 Apple ID の有効な範囲で AI 機能を継続的にご利用いただける買い切り型課金です。Apple が提供する非消費型アプリ内課金の仕様に従い、機種変更時等は Apple の「購入の復元」機能により再有効化できます。
4.4 ローンチキャンペーン
ローンチ記念永久プラン（7,800 円）は、本アプリの公式リリース日から 1 ヶ月間に限り提供されます。期間終了後は通常価格（9,800 円）に戻ります。
4.5 返金
すべての課金は Apple により処理されます。返金は Apple の運用ポリシーに従って Apple が判断します。返金請求の手続については、support.apple.com/ja-jp/HT204084 をご参照ください。当方は決済情報を保持せず、返金処理を直接行うことはできません。
5. 禁止事項
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
- 法令又は公序良俗に違反する行為
- 他者の権利（知的財産権、プライバシー権、名誉権等）を侵害する行為
- 本アプリの解析、改変、リバースエンジニアリング、複製又は再配布
- API プロキシに対する過度なリクエスト、自動化スクリプトによる利用、レート制限の回避その他不正アクセス
- 第三者になりすまし、又は虚偽のアプリ識別子を用いて API にアクセスする行為
- 本アプリの運営を妨害する行為
本アプリはローカルファースト設計のため、当方はユーザーの端末内コンテンツを閲覧・取得できず、コンテンツの能動的なモデレーションは行いません。違法コンテンツの作成・保存に関する責任は、当該ユーザーが負うものとします。
6. ユーザーコンテンツ
ユーザーが本アプリ内で作成・保存したテキスト、写真、音声、書き起こし、タグ、チャット履歴その他の一切のコンテンツ（以下「ユーザーコンテンツ」といいます。）の権利は、ユーザーに帰属します。当方はユーザーコンテンツを閲覧、収集、利用又は AI モデルの学習に使用することは一切ありません。
7. AI 機能に関する免責
本アプリの AI 機能は Anthropic 社の Claude を用いて生成された応答を提供するものであり、以下の性質を有します。
- AI 出力は機械生成によるものであり、誤り、偏り、不適切な表現を含む可能性があります。
- AI 出力は、医療、精神保健、法律、税務、財務その他の専門的助言を構成するものではありません。深刻な悩みや緊急性のある状況においては、必ず資格を有する専門家にご相談ください。
- AI 出力の評価・採否・行動への反映は、すべてユーザー自身の責任において行うものとします。
8. サービスの提供及び無保証
当方は、本アプリ及び AI 機能を「現状有姿（AS-IS）」で提供します。当方は、本アプリの可用性、AI 機能の応答時間、稼働率について保証せず、SLA を提供しません。Anthropic 社又は Cloudflare 社のサービス停止・障害・仕様変更により、AI 機能が一時的に利用できなくなる場合があります。
9. 責任の制限
当方が本規約に基づきユーザーに対して負う損害賠償責任の総額は、日本法において許される最大限度の範囲で、損害発生時から遡って過去 12 ヶ月間にユーザーが当方に対して直接支払った金額（永久プランの場合は購入額の比例按分相当額）を上限とします。
ただし、当方の故意又は重大な過失により損害が生じた場合、及び消費者契約法その他強行法規により責任制限が認められない場合は、この限りではありません。
10. 終了
ユーザーは、本アプリを削除し、必要に応じて Apple ID 経由でサブスクリプションを解約することにより、いつでも本アプリの利用を終了できます。当方は、ユーザーが本規約に違反した場合、又は本アプリの API への不正アクセスが検知された場合、事前の通知をもって（緊急の場合は通知なくして）API 利用を停止又は制限することがあります。
11. 知的財産権
本アプリのソースコード、UI デザイン、ロゴ、ブランド名「MONOLOG」その他関連する一切の知的財産権は、当方又は当方のライセンサーに帰属します。本規約は、ユーザーに対し、当該知的財産権を移転又は許諾するものではありません。
12. 第三者サービス
本アプリは、App Store（Apple）、Claude API（Anthropic）、Workers プロキシ（Cloudflare）と連携します。各サービスにはそれぞれの利用規約及びプライバシーポリシーが適用され、当該第三者の行為については当方は責任を負いません。
13. 本規約の変更
当方は、必要に応じて本規約を変更することがあります。重要な変更については、本ページ及びアプリ内通知により事前に告知し、効力発生日を明示します。変更後の本規約は、効力発生日以降の本アプリの利用に適用されます。
14. 準拠法及び合意管轄
本規約は日本国の法律に準拠します。本規約又は本アプリに関連して生じる一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use ("Terms") govern your use of the iOS application "MONOLOG" (the "App") provided by the MONOLOG developer ("we", "us"). MONOLOG is an independently developed personal app. By using the App, you ("User") agree to these Terms.
1. Scope
These Terms apply to all Users of the App, including users of the free tier and the paid Premium plans. Downloading or using the App constitutes acceptance of these Terms.
2. Minors
Minors must obtain consent from a parent or legal guardian before using the App.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple devices that you own or control. Apple's Licensed Application End User License Agreement also applies, and these Terms supplement it.
4. Premium Plans
Core functionality (text/audio entries, tags, calendar, search, Face ID, audio storage, export/import) is and will remain free forever. Premium unlocks the AI features.

4.2 Auto-Renewal Disclosure
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID, and you may cancel at any time via iOS Settings → Apple ID → Subscriptions.
Renewal charges equal the then-listed price. We do not provide pro-rated refunds for unused portions of a subscription period.
4.3 Lifetime Plan
The Lifetime plan is a one-time non-consumable purchase that unlocks AI features for the associated Apple ID. You can re-activate it on new devices using Apple's "Restore Purchases" feature.
4.4 Launch Campaign
The Launch Lifetime price (JPY 7,800) is available only during the first month after the App's official launch. After that period, the regular price (JPY 9,800) applies.
4.5 Refunds
All payments are processed by Apple. Refunds are determined and processed by Apple under its policies. For refund requests, see support.apple.com/en-us/HT204084. We do not handle payment data or process refunds directly.
5. Prohibited Conduct
You must not:
- Violate any applicable law or public order;
- Infringe third-party rights (IP, privacy, reputation, etc.);
- Decompile, modify, reverse-engineer, copy, or redistribute the App;
- Abuse the API proxy via excessive requests, automation, rate-limit bypass, or other unauthorized access;
- Impersonate another party or use a false app identifier to access the API;
- Otherwise interfere with the operation of the App.
Because the App is local-first, we cannot view your content and do not actively moderate it. You are solely responsible for the legality of content you create.
6. User Content
You retain all rights to the text, photos, audio, transcripts, tags, chat history, and other content you create in the App ("User Content"). We do not access, collect, exploit, or use User Content to train any AI model.
7. AI Disclaimer
The App's AI features are powered by Anthropic's Claude and:
- May contain errors, biases, or inappropriate output;
- Do not constitute medical, mental-health, legal, tax, financial, or any other professional advice. For serious or urgent matters, please consult a qualified professional;
- You are solely responsible for evaluating and acting on AI outputs.
8. Availability and Disclaimer of Warranty
The App and AI features are provided AS-IS. We make no warranty as to availability, response time, or uptime, and provide no SLA. AI features may become temporarily unavailable due to outages or changes at Anthropic or Cloudflare.
9. Limitation of Liability
To the maximum extent permitted by Japanese law, our aggregate liability shall not exceed the total amount you paid to us in the twelve months preceding the event giving rise to the claim (or, for Lifetime purchases, a pro-rated portion of the purchase price). This cap does not apply to liability arising from our willful misconduct or gross negligence, or where Japanese consumer-protection law (Consumer Contract Act, etc.) prohibits such limitation.
10. Termination
You may stop using the App at any time by deleting it and cancelling any subscription via your Apple ID. We may suspend or restrict API access with notice (or without notice in emergencies) if you breach these Terms or if abuse is detected.
11. Intellectual Property
All intellectual property in the App's source code, UI design, logo, and the "MONOLOG" brand belongs to us or our licensors. These Terms do not transfer or license any such rights to you, except for the limited use license granted herein.
12. Third-Party Services
The App interoperates with the App Store (Apple), Claude API (Anthropic), and a Workers proxy (Cloudflare). Each is governed by its own terms and policies, and we are not responsible for the acts of these third parties.
13. Changes
We may amend these Terms as needed. Material changes will be announced via this page and in-app notice, with an effective date. The amended Terms apply to use of the App from the effective date onward.
14. Governing Law and Venue
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute arising from these Terms or the App.
